TULSA — An infant who was killed by his family's 3-month-old Labrador was still lying in an infant swing when the puppy apparently ripped out a portion of the child's abdomen, according to a search warrant affidavit filed Wednesday.
Police have recovered what they believe to be body parts from the dog's stomach. That may indicate child neglect, the affidavit said.
On July 28, 2-month-old Zane Earles had been left in the swing at about 8:30 a.m. by his mother, Linzy Leigh Earles, 17, who went "back to her bedroom and slept,” according to court documents.
New details come to light
In the new report filed Wednesday, the baby's grandmother, Holly Earles, told police that she had gotten up to check on Zane about 9 a.m. and that the baby was sitting in his swing and "seemed to be OK,” so she went back to her bedroom to sleep.
Holly Earles said she woke up again about 10:15 a.m. and went into the dining room — and began screaming when she saw the baby's injuries and saw the dog nearby, the report said.
The grandmother's screams awoke the child's mother, who picked up her son and carried him to Holly Earles' bed, while the grandmother called 911.
Emergency responders pronounced the baby dead at the scene, noting that a large portion of his lower abdomen and left thigh were missing. The puppy was taken to the animal shelter, where he was euthanized for investigative purposes.
Earlier this week, police requested a search warrant to take blood and hair samples from Linzy Earles to determine if drugs or alcohol may have prevented her from hearing screams from the baby.
An earlier affidavit said Linzy Earles had a drug abuse history and was just taken off juvenile probation for drug charges.
Police also plan to conduct a sound test in the home to find out whether screams from the infant should have been heard, the affidavit states.
The state medical examiner's office is awaiting toxicology results before listing the infant's cause of death.
